3. Eligibility

4. User Accounts

• Log out of your account at the end of each session on shared devices

4.3 Account Termination

5. Subscription and Payments

5.1 Free and Paid Plans

TopPlaybook offers both free and paid subscription plans. Free plans include limited features, while paid plans provide access to additional features and increased limits.

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. By subscribing to a paid plan, you authorize us to charge your payment method for the applicable fees.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.

5.4 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our discretion in certain circumstances, such as service outages or billing errors. Refund requests should be submitted through our support ticket system.

5.5 Price Changes

We reserve the right to change subscription prices. Price changes will be communicated in advance and will apply to the next billing cycle after notice is given.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

You are solely responsible for the accuracy and legality of your User Content. We do not verify or endorse any User Content and are not liable for any errors, inaccuracies, or losses resulting from your use of User Content.

7.3 Data Export

You may export your User Content at any time through the features provided in the Service. We recommend maintaining your own backups of important data.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, graphics, logos, and software, is owned by TopPlaybook and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, worldwide, royalty-free license to use and incorporate such feedback into our Service without any obligation to you.

9.1 No Financial Advice

TOPPLAYBOOK IS A JOURNALING AND ANALYTICS TOOL ONLY. WE DO NOT PROVIDE FINANCIAL ADVICE, INVESTMENT RECOMMENDATIONS, OR TRADING SIGNALS. THE SERVICE IS NOT A REGISTERED INVESTMENT ADVISOR, BROKER-DEALER, OR FINANCIAL PLANNER.

All trading decisions are your own. You acknowledge that trading involves substantial risk of loss and that past performance is not indicative of future results. You should consult with qualified financial professionals before making any investment decisions.

9.2 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPPLAYBOOK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Loss of profits, revenue, data, or business opportunities
• Trading losses or investment decisions made using the Service
• Service interruptions, data loss, or security breaches
• Actions of third parties or other users

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless TopPlaybook and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TopPlaybook operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TopPlaybook regarding the Service and supersede all prior agreements and understandings.
